Owners Terms and Conditions

  • 1. Contract of Hire
    All bookings accepted by the owner or the manager of the property are subject to these conditions which are deemed to have been accepted in full by the hirer and all persons in the party. The presented holiday homes have been inspected thoroughly and carefully selected by Sunpool Villas, who provides the service of presentation and mediation.
  • 2. Confirmation of Booking
    A deposit or payment is required to confirm the reservation, upon receipt it, we will send you an email confirming your booking. The reservation is not confirmed until you receive our confirmation email. The balance must be paid according to each property, whether a few days before your holiday or on arrival at the property, we will communicate the type of payment before booking, payment on arrival is not allowed on arrivals after 21:00h. Sunpool Villas acts as limited payment collection agent solely for the purpose of accepting funds from travelers on behalf of the owner.
  • 3. Cancellation by Hirer
    To cancel your booking once it has been confirmed, the person made the booking must email our administration department - admin@sunpool.es. Cancellation free of charge if you cancel up to 24 hours after the first payment, thereafter the deposit is not refundable.
    Cancelation conditions:
    FLEXIBLE: The deposit plus 15% of the total rental amount will be required if the cancellation is made between 90 days and 48 hours before the start of the rental period, if no show or cancellation occurs less than 48 hours before the start date of the rental period, the full amount of your booking will be required.
    Once you cancel, we will strive to book again the cancelled period, and if successful we will refund you either in full if the whole period is booked again, or the part that is booked, to qualify for this refund, cancellation fees must have been paid.
    STRICT: If the cancellation occurs less than 8 weeks before the start date of the rental period, the cancellation fee is the total amount of your reservation.
    The cancellation condition applicable is detailed in the description of each property.
  • 4. Payment Protection
    In the unlikely event that the villa becomes unavailable due to circumstances beyond our control, the hirer will be offered alternative accommodation if available or a full refund of monies paid. In the event that no suitable accommodation can be offered then a full refund of monies already paid for the villa rental will be refunded. Any refund is restricted to the villa hire costs and we are not liable for any cancellation or administration charges for travel arrangements, etc...
  • 5. What is Included
    The villa rental includes the cost of a weekly delivery of bed linen and towels, end of stay clean, water, electricity, maintenance of swimming pool and garden. Any defects or deficiencies must be reported within 48 hours of your arrival. After this time it will be assumed that everything is in order.
  • 6. What is Not Included
    The villa rental prices do not include personal, travel and cancellation insurance, travel, transportation, airport transfers, full resort representation or mid-stay cleaning of the villa. Satellite TV, video, DVD, garden furniture, the computer, the wifi connecion, etc are free items, therefore the availability or function of any such item cannot be guaranteed.
  • 7. Occupancy
    The hirer is required to notify Sunpool Villas, his address, his identity card number, as well as the names and approximate ages of all the members of his group, using an electronic form that will be provided. Only persons listed on this form may occupy the villa. The villa cannot be re-let or sublet to any other group/party or individual without the written approval of the owners. The booking is only valid for the in the contract indicated number of persons. In case the property should be occupied with more persons than indicated in the lease contract, the client will be charged an additional amount according to the current prices. Under no circumstances may more than the maximum number of persons specified in the villa description, or booking form, occupy the villa except by prior written agreement. the owner, or their representatives, reserve the right to refuse admittance to the villa to the hirer and their party if they are in breach of this condition. Sunpool Villas primarily provides holiday homes to families and small groups. Large groups, meaning at least 6 persons who are not related, are welcome as well but shall announce themselves as a group no later than at the time when the reservation is made. If the announcement has not been made, Sunpool Villas and the holiday home owner shall be entitled to reject a group, or request an additional guarantee. Generally we do not accept pets. However, there may be certain exceptions, please enquire. In such cases you must obtain written permission from the owner.
  • 8. Hirer´s Responsibility
    The hirer is responsible for taking all reasonable care of the property and its contents. At the end of the hire period, the property and its contents, including all equipment, furniture, utensils, etc must be left clean and tidy which includes the crockery and cutlery cleaned and stored in the appropriate cupboards and ensure that the cooker, oven, fridge and microwave are clean. The hirer shall ensure that no member of the party engages in any activity in or around the villa and swimming pool which may cause damage, offence to the neighbours, pollution to the water or damage to the structure or filtration equipment, this includes unacceptable anti-social behaviour. The hirer shall also ensure that the barbecue is cleaned and that all rubbish is cleared away from the property and placed in the communal dustbins.
  • 9. Damage to Villa and its Contents
    Except in the case of normal wear and tear, the hirer will be responsible for making good any damage to the villa or its contents which has occurred due to negligence, willful damage or irresponsible behaviour on the part of those occupying the villa or their guests. Such damage must be immediately reported to the owner or its representative. The cost of the replacement or damage must be paid for by the hirer to the owner via its representative. The hirer is obliged to guarantee these potential damage, as well as is described in the Article 7.
  • 10. Rights of Access
    The owner, their representatives or their sub-contractors have the right of access to the villa at any time with due regard to the convenience of the hirer for the purpose of linen changes, inspection of the property and to carry out any essential or routine repair or maintenance work.
  • 11. Responsibilities
    Neither the owner or their representatives can be held responsible for any circumstances beyond their control including, but not limited to, mechanical breakdown, illness, swimming pool maintenance, emptying of swimming pool for necessary maintenance, failure of any public service supply. The hirer responsible for booking undertakes that no person will suffer anything to be done which would endanger the policy of the owner´s insurers in respect of the villa and its contents which might make the same void or voidable.
  • 12. Injury and Damage
    We do not have any responsibility to compensate you for any personal injury, illness, death, loss or damage of whatever nature suffered by you, or any member of your party, during the booking period or thereafter.
  • 13. Villa Arrival and Departure Times
    The villa will be available for occupation and must be vacated according the schedules specified in the description of each villa.
  • 14. Keys, Directions and Local Contact Numbers
    Detailed instructions for key collection and directions to the villa will be sent two weeks prior to the rental commencement, together with a local contact telephone number of a representative working on behalf of the property owner should you have any problems whilst at the villa.
  • 15. Complaints
    In the unlikely event that you have a complaint about the villa or its contents whilst on holiday, it must be reported immediately to the owner or its representatives who will take reasonable steps to resolve the matter. Neither the owner or their representatives shall have any liability for any complaint submitted after the completion of the hire period.
  • 16. Force Majeur
    We regret we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by "force majeur". In these Terms and Conditions of Hire, "force majeur" means any event which we or the supplier of the service(s) in question could not, even with due care, foresee or avoid.
  • 17. Law and Jurisdiction
    This agreement shall be governed by the laws of Spain to which both parties expressly submit.
  • 18. Insurance
    The villa hire cost does not include any personal insurance cover of any kind.
